She entered ihraam for ‘Umrah from Makkah and forgot one or two laps of saa’i

Last year I intended to perform an ‘Umra, 3 or 4 days after I arrived in Makkah. In Makkah some people told me that entering ihram is from Makkah while I am a visitor. Then I started performing an ‘Umra. I forgot one or two circuits of saa’i. I want to perform another ‘Umra next Tuesday. What shall I do about my previous ‘Umra?.

Praise be to Allah, and blessings and peace be upon the Messenger of Allah.

Firstly:

If you entered ihraam for ‘Umrah from inside Makkah, and did not go out to a place beyond the boundaries of the Haram, such as al-Tan’eem or what is called Masjid ‘Aa’ishah (the Mosque of Aa’ishah (may Allaah be pleased with her)), then you failed to do one of the obligatory parts of ‘Umrah, namely entering ihraam from the meeqaat. The meeqaat for ‘Umrah for the people of Makkah and those who are staying there is the area outside the boundaries of the Haram, so the one who is in Makkah and wants to do ‘Umrah must go out to any area that is beyond the boundaries of the Haram and enter ihraam from there. If he does not do that he must offer a sacrifice of a sheep to be slaughtered and its meat to be distributed among the poor of the Haram. See the answer to question no. 48955.

Secondly:

With regard to what you have mentioned about omitting laps of saa’i, if it is only doubt or conjecture that happened after you had finished saa’i, then it does not matter, because doubt after finishing an act of worship does not affect it.

Ibn Qaasim al-‘Aabidi said in his commentary on Tuhfat al-Muhtaaj (4/81): If you are uncertain about the number before you finish (the act of worship), then you must proceed on the basis of the lower number, according to scholarly consensus. If you think something different or are not sure of it afterwards, i.e., after finishing it, it does not matter. End quote.

If you are certain that you did a saa’i of six or five laps, then your saa’i was incomplete and your exiting ihraam from ‘Umrah is not valid. One of the essential parts of ‘Umrah remains to be done, namely saa’i, and you are still in ihraam, and you must do three things:

1.Avoid all the things that are forbidden whilst in ihraam, because you are still in your ihraam.

2.Go back to Makkah and do saa’i from scratch.

3.Exit ihraam but cut a fingertip’s length from your hair, because your first exiting ihraam took place before the rituals had been completed, so it did not count.

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was asked about a man who did ‘Umrah but his saa’i was one lap short. What must he do?

He replied:

This man is still in ihraam and he must stop wearing ordinary clothes and avoid the things that are forbidden whilst in ihraam, and he must immediately put on the ihraam garments in the place where he is, and go to Makkah and do saa’i again, because he is still in ‘Umrah now. End quote.

Majmoo’ Fataawa al-Shaykh Ibn ‘Uthaymeen (22/435).

With regard to any infractions of ihraam that you may have committed during this period, if they were due to ignorance of the ruling, then you do not have to do anything, but if they were done despite your knowing the ruling that you were still in a state of ihraam, then you must offer a fidyah for them.

Thirdly:

It is not prescribed for you to enter ihraam for ‘Umrah from the meeqaat during your upcoming trip (on Thursday), because you are still in a state of ihraam for your first ‘Umrah, as stated above. But if you reach Makkah and complete your first ‘Umrah then exit ihraam, then you want to do a second ‘Umrah, you should go out to al-Tan’eem or anywhere that is beyond the boundaries of the Haram, and enter ihraam for ‘Umrah.
